Voting Rights Act: Is major portion outdated? Supreme Court to hear arguments.

Section 5 of the Voting Rights Act requires some state and local governments to obtain federal clearance for changes in voting procedures. In 2008 the Supreme Court said the section needed updating.

So why is the US Supreme Court being asked to declare a major portion of the landmark Voting Rights Act of 1965 unconstitutional?

On Wednesday, the high court is set to take up a legal challenge filed on behalf of Alabama?s Shelby County, alleging that Congress overstepped its authority when it voted overwhelmingly in 2006 to reauthorize Section 5 of the Voting Rights Act (VRA) for 25 years.

At issue in the case, Shelby County v. Eric Holder (12-96), is a section of the law that gives the federal government extraordinary power to prevent state and local governments from discriminating against minority voters by undercutting their political clout in elections.

In 1965, when the VRA was first enacted, many states, particularly in the Deep South, were actively working to prevent black and other minority voters from effectively exercising their right to vote. They had done it for decades through threats of violence, poll taxes, and literacy tests.

Congress outlawed those blatant tactics, but the discrimination continued in more creative and subtle ways.

To counter it, Congress enacted Section 5 of the VRA. It required certain jurisdictions with a demonstrated history of discrimination in voting to submit any changes in their voting procedures to the Justice Department or a three-judge panel in Washington for approval before any change could take effect.

The measure required federal officials or judges to examine the changes and determine if they were discriminatory or would otherwise have a detrimental effect on minority voting.

There is no dispute about the effectiveness of the measure. It worked well and continues to work well.

The question now is whether discrimination in voting ? nearly 50 years after the 1965 VRA was first passed ? continues to be so egregious as to justify the extraordinary measure of requiring certain targeted state and local governments to obtain permission from Washington before they are allowed to alter their own voting procedures.

When it was first passed, Congress authorized the extraordinary measure for five years. It has since been reauthorized four more times, including for 25 years in 1982 before the 25-year extension in 2006. But instead of reevaluating each covered jurisdiction based on whether or not there is contemporary evidence of discrimination, federal lawmakers decided to continue to rely on the original criteria used in the 1960s and 1970s to determine the most egregious jurisdictions in the country.

Many of the covered jurisdictions, Shelby County among them, insist this is unfair.

The central thrust of Shelby County?s argument boils down to one word: federalism.

Those challenging the constitutionality of Section 5 are asking the high court to strike a balance between Congress?s power to fight discrimination and the constitutional requirement that states be treated as co-equal sovereigns.

Washington, DC, February 27, 2013 -- Patients who tested positive for carbapenem-resistant Enterobacteriaceae (CRE) took an average of 387 days following hospital discharge to be clear of the organism, according to a new study published in the March issue of the American Journal of Infection Control, the official publication of the Association for Professionals in Infection Control and Epidemiology (APIC).

The study was conducted in the Shaare Zedek Medical Center, a 700-bed university-affiliated general hospital in Jerusalem, Israel. The research team analyzed follow-up cultures from 97 CRE-positive patients who had been discharged from the medical center between January 2009 and December 2010.

The average time until cultures became negative was 387 days. At three months, 78 percent of patients remained culture positive; at six months, 65 percent remained positive; at nine months, 51 percent, and at one year 39 percent of patients remained positive, meaning they could potentially become re-infected or transmit the germ to others.

Risk factors for extended carriage included the number of hospitalization days, whether and how often the patient was re-hospitalized, and whether the patient had an active infection as opposed to colonization without signs of active disease.

This is one of the first studies to determine length of CRE duration after hospital discharge and provides vital insight into treating formerly CRE-positive patients upon readmission as to limit the spread of this virulent and often deadly pathogen.

The authors state, "Patients with multiple hospitalizations or those who were diagnosed with clinical CRE disease should be assumed to have a more extended duration of CRE coverage and should therefore be admitted under conditions of isolation and cohorting until proven to be CRE-negative. These measures will reduce the hospitalization of CRE-positive patients among the general patient population, potentially preventing the spread of CRE."

CRE are extremely difficult-to-treat, multidrug-resistant organisms that are emerging in the United States. A CRE strain of Klebsiella pneumoniae recently spread through the National Institutes of Health hospital outside Washington, DC, killing six people. Because of increased reports of these multidrug-resistant germs, the Centers for Disease Control and Prevention recently alerted clinicians about the need for additional prevention steps to prevent transmission.

The US government has to -- to -- ...wait just a minute here. I don't know how the NYT defines "overwhelming", but those Apple/Facebook/Twitter hacks? Snowshoeing - Shawn Wenger, Ethan Wenger 17Lea McLaneEven without the adrenaline factor that popularizes many winter sports, snowshoeing is becoming more accessible and more appealing in Western Canada, if not the world.

We know that snowshoes were developed centuries ago and used around the world, but there?s little certainty about their exact origin. Whatever their genesis, there?s no doubt they were used to provide an efficient means of travelling on snow. Their use has become more recreational over time, with some of the first documented snowshoeing clubs surfacing in Eastern Canada in the 1800s. Today, snowshoeing is a relatively new popular sport and is not yet represented at the Olympics.

One company that can place a claim in helping raise the profile of snowshoeing is Dirty Feet, which runs snowshoe races, along with trail runs and mountain bike races, in B.C.?s Interior.

?Snowshoeing?s been the fastest growing sport in North America for the past 10 years. You?d be amazed at the amount of people going out snowshoeing, it?s huge,? says Grace Hiom, who runs Dirty Feet with her husband Phil, adding that Dirty Feet has seen large increases in registrations since it launched.

The early incarnations of snowshoes were tough wooden frames with webbing made of animal hide, like caribou or deer, between the frame and leather buckles to secure the foot. Hiom said that nowadays they?re much more versatile.

?There?s really a snowshoe for every use. There are running specific snowshoes, recreational type snowshoes and more aggressive stepper snowshoes to give you more traction and a harness system for doing longer steeper stuff,? she explains.

Hiom added that as long as you set them up right the beauty of snowshoeing is that it?s easy.

?You rent some snowshoes and . . . just hike wherever you?d usually hike in the summertime, it makes it easy to just go do it, you don?t have to organize a big group, don?t usually have to pay trail fees (unless in resorts or parks).?

Dirty Feet will bring the North Face Dirty Feet Snowshoe Fun Run and Walk to Sun Peaks for its fourth year on March 3, and Hiom encourages all people to enter.

?The course (at Sun Peaks) isn?t too crazy technical, it?s a fun 5 kilometre loop and the 10 km is two loops of the 5 km. It?s on the snowshoe trails (and) crosses the Nordic trails,? says Hiom.

The event is open to all ages and will be followed by snacks and hot drinks. There will also be a prize presentation that?s not just for the place getters.

?We have a lot of prizes for our races because we like to encourage people to just come out and participate. You can be dead last and win a $200 prize.?

Cost of entry is $30 until February 23, and will increase to $35 on February 24. Registration closes on March 1, and there is no race day registration.

GOSHEN, Indiana ? Union workers at a northern Indiana trailer-hitch manufacturer have voted to forego arbitration and accept a severance agreement that will pay the most senior employees $36,000.

Most of the 350 United Steelworkers Local 9550 workers at Cequent Performance Products in Goshen supported the package in votes tallied Friday night, Local 9550 Vice President Deb Hathaway said.

"No matter what they give us it's still not enough for us losing our jobs," she said.

Steelworkers Sub District 4 Director Mike O'Brien said 240 of the 350 union members at the plant voted. He didn't disclose vote totals.

"It was certainly not unanimous but it wasn't close," O'Brien said. "I think a lot of people looked at, 'Well, this is what the company is offering and we take a chance going to arbitration.'"

Cequent, a subsidiary of Bloomfield Hills, Michigan-based TriMas Corp., announced in November it would move operations from the 450-employee plant 25 miles southeast of South Bend to Reynosa, Mexico, to lower shipping costs.

Workers with less than a year's seniority will receive $500 while those with 30 years or more will receive $36,000. Workers also will receive company health benefits for at least a month after they are laid off. The total severance package is worth more than $3.5 million, O'Brien said.

Layoffs began Friday, but O'Brien said he didn't know how many workers lost their jobs.

More than half the employees are scheduled to remain on the job through the end of June, with the last due to be let go in December.

Florida?s Medicaid expansion could hit legislative opposition

Gov. Rick Scott dropped a bombshell Wednesday when he announced support for a Medicaid expansion. But a day later, it remained unclear whether the idea would get through the Republican-dominated Legislature.

House GOP leaders appear to have the strongest reservations, with Speaker Will Weatherford, R-Wesley Chapel, and Appropriations Chairman Seth McKeel, R-Lakeland, publicly expressing doubts about the wisdom of the expansion.

?I remain skeptical that that?s in the best interests of the state,? McKeel said Thursday morning.

Weatherford, during an appearance before the Florida Retail Federation and in a television interview, also repeatedly used the word ?skeptical.? Pointing to broader federal budget and debt problems, he questioned whether Washington would make good on a promise to pay billions of dollars for the expansion.

?We?re talking about a federal government that is not able to pay its bills,?? Weatherford said during an appearance on the show, ?Florida Face to Face.?

Some Senate Republicans indicated they might be more willing to go along with Scott, who said he would support expanding Medicaid eligibility for three years and then revisiting the issue. The federal government is slated to pay all of the expansion costs for the first three years, before the state has to pick up a portion of the tab.

?I support the governor, and I think the Senate has an open mind on it,?? said Sen. Jack Latvala, R-Clearwater. He later added, ?I think we give it a shot and see how it works.?

Senate Health Policy Chairman Aaron Bean, R-Fernandina Beach, pointed to the possibility that a Medicaid expansion could help ?safety net? hospitals that serve large numbers of low-income and uninsured people. More Medicaid coverage would produce additional revenues for hospitals, helping offset other types of funding cuts.

'Amazon tax' payoff starts to arrive in California, other states

Sales tax from Internet commerce, a prize pursued for years by U.S. state governments, is starting to arrive in California and a few other states, providing millions of dollars in new revenue, though not as much as a benchmark study once forecast.

After fighting hard to get e-tailers such as Amazon.com to start charging sales tax, and eventually passing a law requiring collection, the California Board of Equalization reported last week it took in $96.4 million in September-December 2012, its first full quarter of collections.

Coinciding with the holiday shopping season, that result put the state well on its way to meeting its forecast budget of $107 million in new e-taxes for the fiscal year that began July 1, 2012, as set by the California Department of Finance.

But that revenue falls far short of ambitious expectations set in 2009 by a University of Tennessee study that greatly influenced the online sales tax debate nationwide.

The study estimated that California, if it did not act to collect more online sales tax, would miss out on as much as $1.9 billion in 2012 revenue. Nationwide, it estimated, states would fail to collect $11.4 billion in 2012.

The Tennessee study fueled states' demands in recent years for more tax power over online commerce. Like California, more states will be collecting new e-revenues in months ahead. So it is too soon to make firm judgments, but early results suggest

the Tennessee study and others like it were over-ambitious.

"To the extent the estimates being used are overstating reality, and I think they are, it is not solving anyone's deficit problem," said Jeff Eisenach, a managing director at economic research group Navigant Economics.

Eisenach co-authored a study on e-commerce and sales tax and said he advises being "conservative rather than hopeful."

Eisenach's study, sponsored by NetChoice, a trade group that opposes online taxation, pegged the national online sales tax potential at $3.9 billion, about a third of Tennessee's number.

The dawning of sales tax as a reality in the world of online commerce marks a turning point not only for the states that are starting to collect it, but for Internet vendors and consumers.

Amazon, for instance, for many years and in most states, did not collect sales tax, enjoying as a result a pricing advantage over older, bricks-and-mortar retailers. That is changing fast.

At the moment, Amazon is collecting sales tax in nine states including California, and will add seven more in the next year. In some states the online retailer has struck agreements to collect, in others like California and New York it is complying with new state law.

Having to do that may partly explain a recent deceleration in growth for the world's largest online retailer, said RBC Capital Markets analyst Mark Mahaney, though he added that over time that effect should ease.

For consumers in states where the tax is now being charged online, it means an end to tax-free shopping on the web, at least when it comes to the largest and most developed e-tailers.

Despite moderating revenue expectations, more states are sure to keep pushing for e-commerce taxation because that is where the growth is. Online sales growth has outpaced that of traditional stores for years. By 2015, $175 billion a year will migrate online from stores, Deloitte Consulting estimated.

In the long struggle between states and e-tailers over online sales tax, the Tennessee study was widely cited by those who have pushed for more taxation at the state level and for national legislation to address the issue.

Some state politicians have used figures similar to that of the Tennessee study as a basis for building future Internet sales tax receipts into their budgets.

Virginia Governor Robert McDonnell has projected the state could get $1.6 billion in online sales tax over the next five years. He has predicted that Congress will pass by July 1 a bill to give states the right to require online retailers to collect sales tax. Though this measure has languished in Congress for years, it has recently gained some new political support.

On Thursday, 53 members of the Senate and the House of Representatives reintroduced the bill in Congress.

Representative Steve Womack, a Republican from Arkansas, where the nation's largest brick-and-mortar retailer Wal-Mart Stores is based, said the lack of collection of sales tax online is hurting state and local governments.

"It affects everybody," he said at a press conference for the bill. "It affects schools. It affects policemen, it affects firemen, it affects anybody engaged in public service."

Amazon quickly pledged its support for the national legislation, as it has done in the past.

At the same time, in New York, Amazon and Overstock.com are fighting a state sales tax collection law.

Retailers there are collecting the tax as they fight it out in court. Online retailers have remitted $360 million in sales tax on more than $4 billion in taxable retail sales as of February 2012, according to the New York State Department of Taxation and Finance.

That is 90 percent of all taxable online sales, New York said, but far less than the $2.5 billion the University of Tennessee study predicted for the state over the same period.

In Georgia, the most recent state to require sales tax collection by remote sellers, local retailers said Amazon is not collecting sales tax though the law has required it to do so since January 1. The state's proposed fiscal 2014 budget includes $18 million in new Internet sales tax revenue.

Amazon declined to comment.

"If this revenue doesn't come through we'll have to cut education or some other important area," said Georgia Senator Steve Henson, Democratic leader of the state Senate.

Professor William Fox, leader of the Tennessee study, said that the difference between his study's estimates and lower state collections may reflect the fact that smaller e-retailers often are exempt from collection.

Broader trends support the study's findings, he said, including the fact that sales tax collections have lagged overall economic growth. To Fox, that suggests that untaxed e-commerce has grown, continuing to sap sales taxes.

'Top Chef: Seattle' down to final 2 chefs

LOS ANGELES (AP) ? Kristen Kish is no longer among the leftovers on "Top Chef: Seattle."

The 28-year-old chef de cuisine at Boston restaurant Stir returned in Wednesday's edition of the Bravo cooking competition after facing off against five previously eliminated contestants ? or chef'testants, as they're known in Bravo parlance ? on "Last Chance Kitchen," the weekly companion web series that offers a booted chef the chance to come back.

In the penultimate installment, Kish and unstoppable finalist Brooke Williamson toppled Sheldon Simeon, the 30-year-old executive chef at Star Noodle in Lahaina, Hawaii. Kish and Williamson will go head to head in the Feb. 27 finale, which was taped earlier this month on a Van Nuys soundstage transformed into a massive "Iron Chef"-like culinary stadium.

During the finale, Kish and Williamson will prepare a five-course meal on the fly as the show's panel of judges and a crowd of diners spectate from the sidelines. For the first time in a "Top Chef" finale, the judges will declare winners as each course is served, meaning the competitors might not even make it to dessert if one of the women comes out ahead.

"It's gonna be a great competition," said host Padma Lakshmi. "Whenever it's one against another, it's always more exciting. Both of these chefs are very equally matched, and yet their cooking styles are so different. When I think about all the food I've tasted from Brooke and Kristen, I don't know who my money would be on. It's really anybody's game."

It didn't seem to be Kish's game during the show's annual "Restaurant Wars" challenge, which tasks the contestants with conceptualizing and opening a pair of dueling pop-up eateries. In this season's installment, the teams were divided between men and women, led by Kish. She was controversially eliminated after taking responsibly for her group's failings.

"She really took one for the team," said judge Emril Lagasse earlier this month just before the filming of the final cook-off. "She shouldn't have gone home, and she (went) home taking one for the team. That goes to show you how talented she is because she has fought her way. She's in the finale. It's gonna be incredible tonight to see what goes down."

Williamson, the 34-year-old co-executive chef and co-owner of Los Angeles restaurants Hudson House and The Tripel, has more wins under her chef's hat than anyone else this season. She dominated three quickfire and five elimination challenges over Kish's one quickfire and two elimination challenge victories before she was dismissed from the contest.

"I think Brooke has an advantage in the fact that she's more experienced," said head judge Tom Colicchio before he took his place at the judges' table to shoot the finale. "She's done this longer. She has her own restaurants. She's opened a bunch of restaurants. I think that's an advantage. Also, her plating tends to be a little more basic."

Witness heard "non-stop shouting" before Pistorius shooting

PRETORIA (Reuters) - A witness heard "non-stop shouting" in the home of South African athletics star Oscar Pistorius shortly before his girlfriend was shot dead, the detective leading the murder investigation said on Wednesday.

Warrant officer Hilton Botha, a detective with 24 years on the force, also told the Pretoria magistrates court in a bail hearing that police had found two containers of testosterone and needles in Pistorius' bedroom.

The athlete's defense team said the containers held a herbal remedy taken legally by many athletes, landed some blows to Botha's portrayal of a cold-blooded killing and described inconsistencies and errors in the initial investigation.

Pistorius, a double amputee dubbed "Blade Runner" because of his carbon fiber racing blades, sobbed uncontrollably as Botha presented his testimony about the death of Reeva Steenkamp, 29.

The law graduate and model was in the toilet of the athlete's home when she was shot dead in the early hours of February 14 - Valentine's Day. She was hit in the head, arm and hip.

The shooting and allegations that have emerged at the hearing have stunned South Africa and millions of people around the world who regarded Pistorius, who has no lower legs, as the epitome of physical triumph over adversity.

"One of our witnesses heard a fight, two people talking loudly at each other ... from two in the morning to three," Botha told the court. Pistorius' first call after the incident was to the manager of his high-security complex at 3.19 am, Botha said.

In an affidavit delivered on Tuesday, Pistorius said he woke in the middle of the night and thought an intruder had climbed through his bathroom window and entered the adjoining toilet.

The 26-year-old said he grabbed a 9-mm pistol from under his bed and went into the bathroom.

Pistorius - the highest-profile athlete in the history of the Paralympics - then described how he fired into the locked toilet door in a blind panic in the mistaken belief that the intruder was lurking inside.

After four hours of testimony, the hearing was adjourned until Thursday. It is expected to conclude this week, once the defense and prosecution have outlined their central arguments.

It may then be several months before a trial. If convicted of premeditated murder, Pistorius faces life in jail.

His uncle Arnold said Pistorius was in "extreme shock" and had only started eating again on Tuesday evening. He had spent some of his five days in police custody reading the Bible, he added.

TRAJECTORY

Botha, who arrived on the scene an hour after the shooting, challenged Pistorius' affidavit.

"I believe he knew she was in the bathroom and he shot four shots through the door," the detective said, adding that the angle at which the rounds were fired suggested they were aimed at somebody on the toilet.

Pistorius had said he moved into the bathroom on his stumps - the reason he felt so vulnerable - but Botha said the shots went in a "top to bottom" trajectory, suggesting Pistorius was wearing his artificial legs when he pulled the trigger.

"It seems to me it was fired down," he said.

One of the spent rounds was recovered from the toilet bowl, Botha said.

He also cited a witness in the upscale gated community near Pretoria where Pistorius lived as saying he heard a shot, followed 17 minutes later by more shots. Another witness spoke of a shot, followed by screams, then more shots, he said.

After a vigorous cross-examination from Pistorius' defense, a rattled Botha halved his original estimate of the distance between the witnesses and Pistorius' home to 300 meters.

Lead defense counsel Barry Roux challenged Botha, describing oversights and slip-ups in the initial police investigation.

He disputed the policeman's reference to "testosterone", saying the substance found in Pistorius' bedroom was a legitimate herbal remedy called "testo-composutim co-enzyme".

Details on the makeup of testo-composutim co-enzyme were not immediately available.

Administering testosterone as an anabolic agent is banned at all times under World Anti-Doping Agency rules for sports people.

"HE WILL BOUNCE BACK"

The arrest of Pistorius stunned millions who had watched in awe last year as the Olympic and Paralympic sprinter reached the semi-final of the 400 meters in the London Olympics.

But the impact has been greatest in sports-mad South Africa, where Pistorius was seen as a rare hero who commanded respect from both blacks and whites, transcending the racial divides that persist 19 years after the end of apartheid.

The case has drawn further attention to endemic violence against women in the country after the gang rape, mutilation and murder of a 17-year-old near Cape Town this month.

Arnold Pistorius accused the state of launching a 'public trial' by leaking evidence to the media, and reiterated his belief that his nephew would be exonerated and return to the track and public life.

"Truth will prevail," he said in an interview with South Africa's ENCA television channel. "I know the truth. I know exactly what happened. The puzzle is not going to fit where the state wants to fit it."

"He will bounce back and be greater than ever."

The sprinter's sponsors do not share that confidence.

Sportswear giant Nike and French designer Thierry Mugler have both dropped him from future advertising campaigns and cosmetics firm Clarins is recalling a male perfume range bearing Pistorius' signature.

His other sponsors include British telecoms firm BT and sunglasses maker Oakley.

(AP) ? Grammy-winning fingerpicking guitarist Pat Donohue thinks a South Dakota college town of about 10,000 is an unlikely place for a wide-ranging collection of musical instruments that includes saxophones built by inventor Adolphe Sax, a rare Stradivarius violin with its original neck and a Spanish guitar on which Bob Dylan composed some of his earliest songs.

But that's part of the charm of the 40-year-old National Music Museum, a treasure tucked away in an old Carnegie library building on the University of South Dakota campus.

Donahue, a regular performer on Garrison Keillor's radio show "A Prairie Home Companion," got to play a 1947 D'Angelico New Yorker guitar and a 1902 black and wood-grained guitar built by Orville Gibson for millions of listeners during a 2006 live broadcast from campus.

"The only unfortunate thing that I can think about it is that not enough people are going to see it because of where it is," Donohue said. "But then again, that's one of the things that make it unique."

The National Music Museum has boasted a world-class collection of musical instruments since it was established, and officials now want to build a facility to match that. The museum is looking to raise $15 million over the next few years to triple its gallery space, improve the entrance and revamp the vast archives where music scholars can peruse the thousands of instruments and documents not on public display.

"We'll have a proper lobby and visitor reception area, which we really don't have now," said Ted Muenster, who's leading the fundraising effort for the USD Foundation. "It will be a pretty impressive complex when we're finished with it."

The expansion plans recently earned a federal seal of approval with the awarding of a $500,000 challenge grant from the National Endowment for the Humanities. Endowment chairman Jim Leach visited the museum in 2010 and found its collection of more than 15,000 items "astonishing."

"This is a national treasure," Leach said. "It could just as easily be called the International Music Museum as the National Music Museum. It is one of, if not the, centerpiece of musical instrument collections in the world."

Cleveland Johnson took over as the museum's director in November after the retirement of Andre Larson, who'd been at the helm since it was established in 1973. The holdings grew out of a private collection owned by Larson's father, Arne B. Larson, who continually added items while serving as a public school music director.

The 800 or so instruments on public display are the "superstars" of the broader collection of pianos, harpsichords, guitars, horns and drums.

A keyboard aficionado could marvel at a Neapolitan virginal and harpsichord from the 1530s or the earliest French grand piano known to survive, an ornate green and gold instrument built by Louis Bas in Villeneuve l?s Avignon in 1781.

A fan of stringed instruments would gasp at "The King," the world's oldest known surviving violoncello, which was crafted in 1545 and played by King Charles IX of France in 1562.

"What gets you through the door is a particular interest of yours," Johnson said. "What keeps you here twice as long as you planned are all the unexpected discoveries that you make."

Johnson hopes the expansion and a ramped-up marketing effort will bring more tourists to Vermillion, but he also wants to boost the museum's loans and traveling exhibits to get more exposure. The museum's red, silver and blue tenor saxophone ? donated in 1994 by President Bill Clinton ? was recently displayed at the National Constitution Center in Philadelphia.

"We could double our attendance, but we're still talking about a few tens of thousands a year," he said. "It's not so much getting people through our doors as getting our collection in front of the eyes of people."

The museum scored its greatest public exposure during the "A Prairie Home Companion" broadcast. Museum officials even permitted the playing of "The King" violoncello on air, though such special occasions might happen "maybe once every generation," Johnson said.

It's a decision made on a case-by-case basis, balancing the rarity of the instrument, its condition and the potential audience reach, he said.

Leach said the National Endowment for the Humanities grant is designed to bring in $3 in private donations for every $1 from the government. It also gives the museum a little street cred in cultural circles, since all applications for funding are peer-reviewed.

"We only fund one out of six, and they're all assessed by and graded by experts in fields," Leach said. "This got a wondrous review by a panel on the world's leading experts in not only museum studies but music studies."

Expansion plans call for adding about 65,000 square feet of gallery space to the existing 23,000 square feet. The limited space has not only prevented instruments from getting their proper display, but also has hampered curators' efforts to find creative and hands-on ways to program and teach visitors and school groups, Johnson said.

"The new building is still years away," he said. "I'd imagine it will be fully used the minute they cut the ribbon."

U. MISSOURI (US) ? Couples who are happily married are both mentally and physically healthier than their unmarried peers, new research shows.

The study shows that in all stages of marriage, positive or negative relationships affect health.

Married people are less likely to develop chronic conditions than people who are widowed or divorced?and aging people with failing health could particularly benefit from improving their marriage.

Spouses should be aware that how they treat each other and how happy they are in their marriages affect both partners? health and consider their relationship when thinking holistically about their health, says Christine Proulx, assistant professor in the Department of Human Development and Family Studies at the University of Missouri.

?We often think about the aging process as something we can treat medically with a pill or more exercise, but working on your marriage also might benefit your health as you age,? Proulx says.

?Engaging with your spouse is not going to cure cancer, but building stronger relationships can improve both people?s spirits and well-being and lower their stress.?

Health professionals should consider patients? personal relationships when designing health promotion programs or treatment plans, Proulx says.

?Physicians should recognize that the strength of patients? marriages might affect their health.?I suspect we?d have higher rates of adherence to treatment plans for chronic illnesses if medical professionals placed more of an emphasis on incorporating families and spouses in patients? care. If spouses understand their partners? disease and how to treat it at home, and the couple has a strong marriage, both people?s health could improve.?

Proulx analyzed data from 707 continuously married adults who participated in the Marital Instability Over the Life Course panel study, a 20-year, nationwide research project started in 1980 with funding from the Social Security Administration?s Office of Research and Statistics and the National Institute on Aging. The findings are scheduled for publication in the Journal of Family Psychology.

Most study participants were Caucasian, had more than high school educations, and earned more than $55,000 in annual family income in 2000. Because of these characteristics, the participants probably had some protection against marital and health challenges more commonly faced by people of different ethnicities or with less education or income, Proulx says.

Rubio Fails to Deliver on Guns and Immigration Reform in Reponse to State of the Union

Yahoo News asked readers to react to Sen. Marco Rubio's Republican response on Tuesday night. Here's one perspective.

COMMENTARY | Guns and immigration reform: These were the two topics I most wanted to hear about from Sen. Marco Rubio, in his response to President Obama's State of the Union speech. I was hoping the Republican Party would signal a new beginning, and attempt to reach out to those who didn't vote for them in the last election.

After all, Rubio is Latino, and charming, and has even favored immigration reform in the past. And all day long, I had watched a dramatic gun battle playing out live on my TV between police in nearby San Bernardino and one Chris Dorner. (I live in Los Angeles.) I had guns on the brain, and it was disturbing. I wanted to hear my leaders, and especially aspiring leaders, address the difficult issue of guns.

So I hoping Rubio would at least address the topic of gun control. Unfortunately, Rubio came off as nervous and very, very thirsty. When he finally addressed the issue, he merely admonished the President not to "take our guns." To me, this is the same tired, false threat Republicans use to pander to their fringe elements.

I realized Rubio did not, and maybe could not given the time, respond directly to the President's rousing call in his speech for gun control. But despite that, I was hoping for so much more from this young Republican who wants to lead us, as a nation, into the future. At least he's still for immigration reform, for now.

Mali threatens to become another Afghanistan: Canada

OTTAWA (Reuters) - Canada is unlikely to commit troops to the French-led campaign against Islamist rebels in Mali because it is threatening to become a counter-insurgency operation similar to those in Iraq and Afghanistan, Foreign Minister John Baird said on Tuesday.

Last month Ottawa extended the loan of a C-17 military cargo plane to the French operations in Mali until February 15, while making clear it had no plans to contribute soldiers.

"I am very cautious about sending in potentially thousands of Canadian troops to Malian soil ... to what is already is amounting to a counter-insurgency. We're not at the drop of a hat going to get into another Afghanistan," Baird told a parliamentary committee.

Canada's appetite for military intervention is low following 10 years of military involvement in Afghanistan, ending in 2011, during which 158 soldiers were killed. Canada stayed out of the U.S.-led invasion of Iraq in 2003.

Baird also laughed off the suggestion that Canada could eventually provide troops to serve as peacekeepers.

"On one side we have a military government that took power in a coup last year and on the other side an al Qaeda affiliate. I don't think they're going to sign on for a peacekeeping mission," Baird said.

"It's very much going to be an insurgency on the ground like we've seen in Iraq and like we've seen in Afghanistan."

Rather than sending in troops Canada could support West African regional group ECOWAS, the United Nations and Mali's neighbors, Baird said. He did not give details.

Cancer death rates among African-American men declined faster than those of white men in the last decade, even though overall survival rates for black men and women remained the lowest of all racial groups for most types of cancer, according to a recent report.

In a study published Tuesday in CA: A Cancer Journal for Clinicians, researchers found that while the racial gap was closing for lung and smoking-related cancers, as well as prostate cancer, the disparity between black and white patients was widening for colorectal cancer and breast cancer.

"To the extent to which these disparities reflect unequal access to healthcare versus other factors remains an active area of research," wrote lead author Carol DeSantis, an epidemiologist with the American Cancer Society. "Overall, progress in reducing cancer death rates has been made, although more can and should be done to accelerate this progress through ensuring equitable access to cancer prevention, early detection, and state-of-the-art treatments."

From 2000 to 2009, the cancer death rate among all American males declined faster among blacks than among whites (by 2.4 percent per year for blacks vs. 1.7 percent for whites), the authors wrote. For women, the difference was much less pronounced: a 1.5 percent decline for black women and 1.4 percent for white women.

Lung cancer mortality remains higher for blacks than for whites. However, authors wrote that if the current trends continue, racial differences could be eliminated for lung cancer in 40 to 50 years.

"Smoking prevalence decreased more rapidly in African Americans aged 25 years to 34 years compared with whites," the authors wrote. "African American adolescents also initiate smoking at a much lower rate than their white counterparts."
